Agreement
By using tropiplants.com or placing an order you accept these terms. If you do not agree with them, please do not order.
Minimum order
Six plants per variety. There is no minimum order value, no minimum number of varieties, and no small-order fee. Mix varieties freely; we simply cannot sell fewer than six of any one plant.
Payment terms
All orders are paid upfront. We do not offer credit, terms, net accounts, or financing under any circumstances, and we do not accept checks.
Accepted methods:
- Card — processed by Stripe, subject to a 3% processing fee disclosed at checkout and shown as a separate line on your receipt. By paying this way you also accept Stripe's terms. We never see or store your card details.
- Venmo — @Russell-Loomis-4, paid after the order is placed.
- Zelle — (727) 254-9153, paid after the order is placed.
- Cash — local pickup only.
Orders awaiting a Venmo or Zelle payment are held for 5 days. After that we release the plants back into available stock without further notice. No order is confirmed, packed, or shipped until payment has cleared in full.
Sales tax
No sales tax is charged. Florida exempts seedlings, cuttings, and plants grown to produce food for human consumption, which describes our entire catalog. Where a purchaser has a tax obligation in their own state, meeting it is their responsibility.
Pricing and availability
Prices are in US dollars and are subject to change without notice. The 3% card processing fee is the only surcharge we apply, and only to card payments. Stock counts are kept current, but a plant may sell out between your adding it to a cart and completing checkout. If we cannot fulfil something you have paid for, we refund that line in full.
We reserve the right to correct pricing errors and to cancel and refund any order affected by one.
Substitutions
We will never substitute one variety for another without your consent. If something becomes unavailable after you order, we will contact you to arrange a replacement of your choosing or refund that line.
Shipping and risk
We ship to the contiguous United States (the lower 48 plus Washington DC) only. We do not ship to Hawaii, Alaska, Puerto Rico, or internationally. Certain plants additionally cannot be shipped to certain states under agricultural regulation; those restrictions are enforced at checkout and listed on our shipping page.
Orders ship at the purchaser's risk. Title and risk of loss pass to the purchaser when the carrier collects the shipment. Any claim for transportation damage or loss in transit is between the purchaser and the carrier, and must be filed with that carrier.
Transit times are estimates, not guarantees, and we are not liable for carrier delays. We reserve the right to hold a shipment during extreme weather and will notify you if we do. You are responsible for supplying a correct, deliverable address and for being able to receive a perishable package; additional charges arising from a bad address are yours.
Claims
Every order is packed and inspected before it leaves us. Once it is with a carrier we no longer control how it is handled, and rough handling can dislodge plants in transit.
Unpack and inspect everything immediately on arrival. Claims must be made within 48 hours of delivery by email or phone, and a photograph of the plant material being claimed is required. We cannot consider a claim without one.
Some cosmetic leaf damage during packing and shipping is normal. Most of what we sell is fast growing and forgiving; damaged leaves recover quickly once the plant is potted and watered, and that is not a defect. See our claims and guarantee page for what is and is not covered.
Guarantee
We supply plants that are healthy, disease free, and true to name. In the event that any stock is proven untrue to its name as labelled, our liability is limited to replacing the material free of charge or refunding the purchase price, at your choice.
Time-to-fruit figures and growth descriptions are estimates based on reasonable growing conditions. They are not a guarantee of when, or whether, a given plant will fruit for you. Living plants vary in size, leaf count and form; we describe pot size and shipped height accurately, but no two are identical.
Cancellations and returns
You may cancel any order before it ships or is collected, for a full refund — just email or call. Because they are perishable living goods, we do not accept returns of plants that arrived in good condition.
Local pickup
Local pickup is free, in Pinellas Park, FL, and by appointment only. Call (727) 254-9153 to confirm availability and agree a time before travelling; the exact address is provided once an appointment is confirmed. Orders not collected within 14 days of the agreed date may be cancelled and refunded less any restocking loss.
Limitation of liability
To the fullest extent permitted by law, our total liability for any claim relating to an order is limited to the actual purchase price of the plant material concerned. We are not liable for indirect or consequential losses of any kind, including lost harvests, lost resale value, labour, damage to other plants, or loss of profit.
Intellectual property
Text, photographs and design on this site belong to Tropiplants and may not be reproduced commercially without permission.
Changes
We may update these terms. The version in force for your order is the one published when you placed it.
